Challenges UK Recruiters Face When Expanding to the US

US expansion is no longer a move considered only by the largest agencies in the industry, now that smaller, more agile firms are also making the leap to capitalise on the booming market. But while the rewards can be substantial, recruiters, both big and small, face several hurdles in setting up business.
Unlike the centralised structure here in the UK, US employment law operates on both federal and state levels. While federal regulations set the baseline, each state imposes its own additional rules, creating a myriad of legal requirements that can vary significantly state-to-state.

Agencies must also consider matters such as transfer pricing, sales and use tax, and nexus laws to avoid any costly missteps. Additionally, staying compliant with Permanent Establishment (PE) rules is critical to preventing unintended tax liabilities. With all these intricacies to think about, careful, strategic tax planning becomes essential to successfully, and compliantly, operate in the US.
